RULES - ENGLISH VERSION

Getaround (SAS with a capital of €1,231,552.50 - RCS Paris n°522 816 651 - registered office at 35 rue Greneta 75002) has decided to launch a photo competition on its Instagram page accessible via @getaround_europe (the "Game") to offer two (2) Participants (as defined below) a voucher to the value of fifty euros (€50), valid for six (6) months on the Getaround platform, which can be accessed via uk.getaround.com as of its issue (the "Prize").

Participation in the Game implies full acceptance and submission of these Game rules and regulations which are set out in the terms and conditions of the Game (the "Rules"), Getaround's general terms and conditions of use available here, the privacy policy (the "Privacy Policy") available here, and the rules of conduct in force on the Internet (netiquette, codes of conduct, etc.).

Any breach of one or more of the above terms and conditions may, at Getaround's discretion, result in the Participant's disqualification from the Game.

Article 1. Conditions of Entry

1.1 This Game is open to any person meeting the following cumulative conditions (the "Participant"):

• registered as a renter on the Getaround platform (i.e. registered on the platform to rent a vehicle)
• A permanent resident in, France or the United Kingdom;
• of legal age in their country on the day they enter the competition;
• have access to an internet connection, and;
• have a valid email address.

Only one entry per person is permitted (same surname, first name, postal address and email address).

1.2 All employees and representatives of Getaround, its partners and subcontractors, as well as their advisors and family members (direct ascendants and descendants) and spouses (marriage, civil partnership, cohabitation) and minors are excluded from any benefit of the Game.

Article 2. Terms & conditions of entry

The Game runs from 13 July 2022 at 10:00 am until 31 August 2022 at 6:00 pm (the "Game Period").

Participation in the Game takes place as follows:

• On 13 July 2022 at 10:00 a.m., Getaround will publish a post on its Instagram page (@getaround_europe) indicating the terms and conditions of the Game and the link to the Rules;
• During the Contest Period, Participants shall:
• subscribe to Getaround's Instagram account (@getaround_europe) and like the post announcing the Contest
• Take a photo of the rented car via the Getaround platform in accordance with the Criteria defined below (the "Photo").
• At the Participant's option, this Photo must then:

Be published on his/her instagram account mentioning the hashtag #getaroundeurope and @getaround_europe; or

Be sent to Getaround's Instragram account (@getaround_europe) via Instagram's direct messaging system.

By submitting their Photo, Participants agree that the Photo may be published on the Getaround account (@getaround_europe) in the event that the Participant is selected as a Winner.

Entries meeting all of the above conditions are hereinafter referred to as "Entries. Participants who do not meet all of these conditions will not be able to attempt to win the Prize, without being able to claim any compensation in any form whatsoever.  

To be taken into account, the Photo must meet all of the following criterias (the "Criterias"):

• Be clear and not blurred;
• Showcase a photo of the car rented via the Getaround platform by the Participant;
• Showcase the car or a distinctive feature of the car (interior or exterior) that is clearly identifiable in the photo;
• The car must be in front of a clear landscape or outdoor area, referring to the holiday.
• Any natural areas (i.e. where driving is prohibited) are excluded;
• Cannot feature traffic violations or excessive speeding of the car and does not exploit the appeal of speed or evoke the power of the car or its braking ability in order to encourage speed;
• Does not contain any content that is sexual, violent, criminal, terrorist, incites hatred, threatening, promotes regulated goods, provides false information, infringes on the services offered by Getaround or any of its competitors, violates the property rights of any third party, or could be considered harassment, nudity or self-harm;
• Adheres to Instagram's terms of use available at https://help.instagram.com/;
• In the event that people are identified or identifiable in the Photo, the Participant must have obtained their permission to use their image in the Game.
  

Article 3. Designation of the winner and award of the Prize

3.1. As of September 1st, the Publications will be evaluated by the Getaround marketing team who will select, at its sole discretion, two (2) Publications that best meet the Criteria.

3.2. The three Participants who are the authors of the selected Publications will be contacted by Getaround via private Instagram message. If the selected Participant: (i) cannot be contacted; (ii) does not respond within three (3) days and/or (iii) refuses the Prize, the latter shall definitively forfeit the rights to receive the Prize without any subsequent compensation being claimed in this respect. In this case, another Participant will be designated under the same conditions as defined in articles 3.1 and 3.2.

3.3. After contacting the three Participants and verifying that they comply with all of the Rules, including any additional checks required by Getaround, the Participants shall be definitively declared "Winners" of the Contest.

3.4. Upon confirmation of their details, and within a maximum of seven (7) working days, the Winners will receive by e-mail the Prize, namely a coupon worth fifty euros (€50) that can be used on the Getaround platform (getaround.com) and is valid for six (6) months from its issue date.

The Prize is personal and cannot be exchanged or refunded for cash and is not refundable or transferable. The Winners will be responsible for the use of the Prize before its expiry date. Any Prize not used during its validity period will become obsolete and remain the property of Getaround.

3.5. The results of the Contest will be communicated to other Participants by sharing on Getaround's Instagram account (@getaround_europe) the Photos of the Winners, mentioning their first name and/or their Instagram nickname and their city of residence. The sharing of the Winners' Photos does not give rise to any consideration other than the Prize to the Winners.

Article 4. Processing of personal data

4.1. In order to participate in the Game, Participants must provide certain personal information about themselves such as their Instagram username or real name. Only Winners will be required to provide their email address or other identifying information necessary to verify compliance with the Rules and to receive the Prize.

4.2 Any personal data collected by Getaround will be treated in accordance with its privacy policy accessible via https://fr.getaround.com/privacy .

Article 5. Limitation of liability

5.1. INSTAGRAM IS NOT INVOLVED IN ANY WAY IN THE ORGANIZATION OF THE GAME. THE GAME IS NOT MANAGED, SPONSORED OR ENDORSED BY INSTAGRAM. INSTAGRAM SHALL IN NO WAY BE HELD LIABLE IN THE EVENT OF A DISPUTE RELATED TO THE GAME. FOR ANY QUESTIONS, COMMENTS AND/OR COMPLAINTS REGARDING THE GAME, PARTICIPANTS SHOULD SEND A PRIVATE MESSAGE TO THE INSTAGRAM ACCOUNT OF GETAROUND (@GETAROUND_EUROPE).

5.2 Getaround shall not be held responsible for any loss, delay, error, in particular due to a failure of computer equipment, software, Internet browsers, computer networks or Internet connections affecting or not affecting the Participants' computer equipment.

5.3. Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network. Consequently, Getaround shall not be held responsible under any circumstances, without this list being exhaustive, for

• the transmission and/or reception of any data and/or information on the Internet;
• any malfunction of the Internet network preventing the proper conduct/functioning of the Game;
• failure of any receiving equipment or communication lines;
• loss of any paper or electronic mail and, more generally, loss of any data;
• problems with delivery;
• the functioning of any software;
• the consequences of any virus, computer bug, anomaly, technical failure;
• any damage caused to a Participant's equipment;
• any technical, hardware or software failure of any kind, which prevents or limits the possibility of participating in the Game or which damages a Participant's system;
• the malfunctioning of the Prize distributed in the context of the Contest, and any direct and/or indirect damage that they may cause.
  

5.3 Getaround may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, including computer fraud. Getaround reserves the right, in such a case, not to award the Prize to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts. Getaround shall not, however, incur any liability whatsoever towards the Participants as a result of any fraud committed.

5.4. Getaround reserves the right to permanently exclude from the Game any person who, through fraudulent behavior, interferes with the proper conduct of the Game, in particular but not exclusively, through the use of robots or any other automated process.

5.5. Getaround shall not be liable in any way for any loss or damage arising from the acceptance and/or use of the Prize.

5.6. Getaround reserves the right to cancel, suspend or modify the Game in the event that the Game cannot be completed due to an event of force majeure, or any bug, virus, intrusion or technical error.

Article 6. Literary and Artistic Property Rights

The images used on Getaround's Instagram account, the objects represented, the brands and trade names mentioned, the graphic elements, the computer elements and the databases making up the Game are the exclusive property of their respective owners and may not be extracted, reproduced or used without the written authorisation of the latter, under penalty of civil and/or criminal proceedings.

Article 7. Reimbursement of participation fees

Postage costs related to requests for the Rules (second-class postage at the current rate), can be reimbursed on simple written request by sending banking details (RIB, RIP or RICE) to the following address:

Reimbursement of internet connection costs for participation in the Game, up to a maximum of 3 minutes and excluding mobile participation, may be obtained by sending a written request to the Getaround address, clearly specifying the following information: surname, first name, full postal address, date and time of participation. The request for reimbursement must be accompanied by a bank details form and a copy of the Participant's internet service provider's invoice showing: the exact nature of the internet service provider's service and its method of invoicing (unlimited, flat rate, etc.) and, the date and time of connection corresponding to participation in the Game clearly underlined or highlighted by the Participant.

Given the current state of services and technology, some Internet service providers offer a free or flat-rate connection to Internet users, it is expressly agreed that any participation in the Game carried out on a free or flat-rate basis (such as, in particular, connection by cable), it is expressly agreed that participation in the Game on a free or flat-rate basis (such as connection by cable, ADSL or specialised connection) shall not give rise to any reimbursement, insofar as the subscription to the services of the access provider is, in this case, contracted by the Participant for his/her use of the Internet in general and the fact that the Participant connects to the platform and participates in the Game does not give rise to any additional costs or expenses.

The cost of photocopying any supporting documents to be provided will be reimbursed on the basis of 0.10 euro (including tax) per sheet.

Article 8. Applicable law & jurisdiction

Prior to any legal action relating to or in connection with these Rules (in particular their application or interpretation), Participants can choose to contact Getaround in order to attempt to settle their dispute amicably and extrajudicially.

Participants are subject to French regulations and laws. Any dispute that cannot be settled amicably shall be brought before the competent courts in France.

Règlement du jeu - FR VERSION

La société Getaround (SAS au capital de 1.231.552,50 euros - RCS Paris n°522 816 651 - siège social au 35 rue Greneta 75002) a décidé de lancer un jeu concours photo sur sa page Instagram accessible via @getaround_europe (le “Jeu”) pour offrir à deux (2) Participants (définis ci-après) un coupon d’une valeur de cinquante euros (50€) valable six (6) mois sur sa plateforme accessible via fr.getaround.com à compter de son émission (le “Lot”).

La participation au Jeu implique l’acceptation et la soumission sans réserve du présent règlement du Jeu qui en fixe les conditions et les modalités (le “Règlement”), des  conditions générales d’utilisation de Getaround (les “CGU”) disponibles ici, de la politique de confidentialité (la “Politique de Confidentialité”) disponible ici, des règles déontologiques en vigueur sur Internet (nétiquette, codes de conduite, etc.).

Toute violation d’une ou de plusieurs stipulations des conditions susmentionnées pourra, à la discrétion de Getaround, entraîner la disqualification du Participant au Jeu.

Article 1. Conditions de Participation

1.1. Ce Jeu est ouvert à toute personne remplissant les conditions cumulatives suivantes (le “Participant”):

• inscrit en qualité de locataire sur la plateforme Getaround (c’est-à-dire s’être inscrit sur la plateforme pour louer un véhicule);
• résidant en France ou au Royaume-Uni;
• majeurs dans leur pays au jour de leur participation au Jeu;
• ayant accès à une connexion internet, et;
• disposant d’une adresse email valide.

Une seule participation par personne est autorisée (même nom, prénom, adresse postale et adresse e-mail).

1.2. Sont exclus de tout bénéfice du Jeu, l’ensemble des salariés et représentants de Getaround, de ses partenaires, et de ses sous-traitants, ainsi que de leurs conseils et des membres de leur famille (ascendants et descendants directs) et conjoints (mariage, partenariat civil, cohabitation) et les mineurs.

Article 2. Modalités de participation

Le Jeu se déroule du 13 juillet 2022 à 10h00 jusqu’au 31 août 2022 à 18h (la “Période du Jeu”).

La participation au Jeu se déroule comme suit:

• Le 13 juillet 2022 à 10h, Getaround publiera une publication sur sa page Instagram (@getaround_europe)  indiquant les modalités du Jeu et le lien vers le Règlement;
• Pendant la Période du Jeu, les Participants devront:
• s’abonner au compte Instagram de Getaround (@getaround_europe) et liker la publication annonçant le Jeu
• Prendre une photo de la voiture louée via la plateforme Getaround en respectant les Critères définis ci-après (la “Photo”).
• Au choix du Participant, cette Photo devra ensuite:
• Etre publiée sur son compte instagram en mentionnant le hashtag #getaroundeurope et @getaround_europe; ou
• Être envoyée au compte Instragram de Getaround (@getaround_europe) via   la messagerie directe d’Instagram.

En envoyant leur Photo, les Participants acceptent que cette dernière soit publiée sur le compte de Getaround (@getaround_europe) dans le cas où le Participant est sélectionné comme Gagnant.

Les participations réunissant l’ensemble des conditions susvisées sont ci-après dénommées les « Participations. Les Participants ne respectant pas toutes ces conditions ne pourront pas tenter de remporter le Lot, sans pouvoir prétendre à aucune indemnité sous quelque forme que ce soit.  

Pour être prise en compte, la Photo devra respecter l’ensemble des critères suivants (les “Critères”):

• Être nette;
• Qu’il s’agisse d’une photo d’une voiture louée via la plateforme Getaround par le Participant;
• Que cette voiture ou qu’un élément distinctif de cette voiture (intérieur ou extérieur) soit clairement identifiable sur la photo;
• Que la voiture soit devant un paysage ou un espace extérieur clair, faisant référence aux vacances. Sont exclus tout espace naturel (c’est-à-dire où il est interdit de rouler);
• Ne mettant en scène ni des infractions au code de la route, ni la vitesse de la voiture et n’exploitant pas l’attrait que la vitesse pourrait représenter ou évoquant la puissance de la voiture, sa capacité de freinage dans le but d’encourager la vitesse;
• Ne comportant aucun contenu sexuel, violent, criminel, terroriste, incitant à la haine, menaçant, faisant la promotion de marchandises réglementées, délivrant de fausses informations, portant atteinte aux services proposés par Getaround ou par l’un de ses concurrents, violant les droits de propriété d’un tiers ou pouvant être considéré comme du harcèlement, de la nudité ou de l’automutilation;
• Respectant les conditions d’utilisation d’Instagram accessibles https://help.instagram.com/;
• Dans le cas où des personnes sont identifiées ou identifiables sur la Photo, le Participant doit avoir obtenu leur autorisation d’utiliser leur l’image dans le cadre du Jeu.

Article 3. Désignation du gagnant et attribution du Lot

3.1. A compter du 1er septembre, les Publications seront évaluées par l’équipe marketing de Getaround qui sélectionnera, à sa seule discrétion, deux (2) Publications répondant au mieux aux Critères.

3.2. Les trois Participants, auteurs desdites Publications sélectionnées, seront contactés par Getaround par message privé Instagram. Si le Participant sélectionné : (i) ne peut pas être contacté ; (ii) ne répond pas dans les trois (3) jours suivant le message de Getaround et/ou (iii) refuse le Lot, ce dernier renonce définitivement aux droits de recevoir le Lot sans qu’aucune compensation ne puisse être réclamée ultérieurement à ce titre. Dans ce cas, un autre Participant sera désigné dans les mêmes conditions que définis en article 3.1 et 3.2.

3.3. Après avoir contacté les trois Participants et vérifié qu’ils satisfont à l’ensemble du Règlement en se soumettant notamment aux éventuelles vérifications supplémentaires requises par Getaround, les Participants seront définitivement déclarés “Gagnants” du Jeu.

3.4. A compter de la confirmation de leur coordonées, et dans un délai de sept (7) jours ouvrés maximum, les Gagnants recevront par e-mail le Lot, à savoir un coupon d’un valeur de cinquante euros (50€) utilisable sur la plateforme Getaround (fr.getaround.com) et valable pendant 6 mois à compter de sa date d’émission.

Le Lot est personnel et ne peut faire l’objet ni d’un échange, ni donner lieu à une contrepartie en numéraire et il n’est ni remboursable, ni cessible. Les Gagnants seront responsables de l’utilisation du Lot avant sa date d’expiration. Tout Lot non utilisé pendant sa période de validité sera caduc et demeurera acquis à Getaround.

3.5. Les résultats du Jeu seront communiqués aux autres Participants par le partage sur le compte Instagram de Getaround (@getaround_europe) des Photos des Gagnants en mentionnant leur prénom et/ou leur pseudonyme Instagram et leur ville de résidence. Le partage  des Photos des Gagnants ne donne lieu à aucune contrepartie autre que le Lot aux Gagnants.

Article 4. Traitement des données à caractère personnel

4.1. Pour participer au Jeu, les Participants doivent fournir certaines informations personnelles les concernant telles que leur nom d’utilisateur d’Instagram ou leur nom réel. Seuls les Gagnants devront fournir leur adresse e-mail ou tout autre information d’identification nécessaire pour vérifier leur conformité au Règlement et pour pouvoir recevoir le Lot.

4.2. Toute donnée personnelle collectée par Getaround sera traitée conformément à sa politique de confidentialité accessible via https://fr.getaround.com/privacy .

Article 5. Limitation de responsabilité

5.1. INSTAGRAM N’EST IMPLIQUÉ EN AUCUNE MANIÈRE DANS L’ORGANISATION DU JEU. LE JEU N’EST PAS GÉRÉ, SPONSORISÉ OU PARRAINÉ PAR INSTAGRAM. CE DERNIER NE POURRA EN AUCUN CAS ÊTRE TENU COMME RESPONSABLE EN CAS DE LITIGE LIÉ AU JEU. POUR TOUTE QUESTION, COMMENTAIRE ET/OU PLAINTE CONCERNANT LE JEU, LES PARTICIPANTS DEVRONT S’ADRESSER ENVOYER UN MESSAGE PRIVÉ AU COMPTE INSTAGRAM DE GETAROUND (@GETAROUND_EUROPE).

5.2. Getaround ne saurait être tenue responsable pour toute perte, tout retard, erreur, en particulier du fait d’une défaillance des équipements informatiques, logiciels, navigateurs Internet, réseaux informatiques ou connexion Internet affectant ou non l’équipement informatique des Participants.

5.3. La participation au Jeu implique la connaissance et l'acceptation des caractéristiques et des limites de l'Internet, notamment en ce qui concerne les performances techniques, les temps de réponse pour consulter, interroger ou transférer des informations, les risques d'interruption, et plus généralement, les risques inhérents à toute connexion et transmission sur Internet, l'absence de protection de certaines données contre des détournements éventuels et les risques de contamination par d'éventuels virus circulant sur le réseau. En conséquence, la Getaround ne saurait en aucune circonstance être tenue responsable, sans que cette liste soit limitative :

• de la transmission et/ou de la réception de toute donnée et/ou information sur Internet ;
• de tout dysfonctionnement du réseau Internet empêchant le bon déroulement/fonctionnement du Jeu;
• de défaillance de tout matériel de réception ou des lignes de communication ;
• de perte de tout courrier papier ou électronique et, plus généralement, de perte de toute donnée ;
• des problèmes d'acheminement ;
• du fonctionnement de tout logiciel ;
• des conséquences de tout virus, bogue informatique, anomalie, défaillance technique;
• de tout dommage causé à l’appareil d'un Participant ;
• de toute défaillance technique, matérielle et logicielle de quelque nature, ayant empêché ou limité la possibilité de participer au Jeu ou ayant endommagé le système d'un Participant ;
• du dysfonctionnement du Lot distribué dans le cadre de l’Opération, et des éventuels dommages directs et/ou indirects qu'ils pourraient causer.
  

5.3. Getaround pourra annuler tout ou partie du Jeu s’il apparaît que des fraudes sont intervenues sous quelque forme que ce soit, notamment de manière informatique. Getaround se réserve, dans cette hypothèse, le droit de ne pas attribuer le Lot aux fraudeurs et/ou de poursuivre devant les juridictions compétentes les auteurs de ces fraudes. Getaround ne saurait toutefois encourir une responsabilité d’aucune sorte vis-à-vis des Participants du fait des fraudes éventuellement commises.

5.4. Getaround se réserve le droit d’exclure définitivement du Jeu, toute personne qui, par son comportement frauduleux, nuirait au bon déroulement du Jeu, notamment mais non exclusivement, par l’utilisation de robot ou tout procédé automatisé.

5.5. Getaround ne sera en aucun cas responsable de toute perte, tout dommage du fait de l’acceptation et/ou l’utilisation du Lot.

5.6. Getaround se réserve le droit d’annuler, suspendre ou modifier le Jeu en cas d’impossibilité de finaliser le Jeu en raison d’un événement de force majeure, ou de tout bug, virus, intrusion ou erreur technique.

Article 6. Droits de Propriété Littéraire et Artistique

Les images utilisées sur le compte Instagram de Getaround, les objets représentés, les marques et dénominations commerciales mentionnées, les éléments graphiques, informatiques et les bases de données composant le Jeu, sont la propriété exclusive de leurs titulaires respectifs et ne sauraient être extraits, reproduits ou utilisés sans l’autorisation écrite de ces derniers, sous peine de poursuites civiles et/ou pénales.

Article 7. Remboursement des frais de participation

Le remboursement des frais d’affranchissement relatifs à la demande du Règlement (timbre au tarif lent en vigueur), peut être obtenu sur simple demande écrite en joignant un R.I.B conjointe à l’adresse suivante :

Le remboursement des frais de connexion internet pour participer au Jeu, dans la limite maximum de 3 minutes et hors participation mobile, peut être obtenu sur simple demande écrite à l’adresse de Getaround en précisant lisiblement les informations suivantes : nom, prénom, adresse postale complète, date et heure de participation. La demande de remboursement devra être accompagnée d’un RIB et d’une copie de la facture du fournisseur d’accès à internet du Participant où apparaissent : d’une part la nature exacte de la prestation du fournisseur d’accès à internet et son mode de facturation (illimitée, forfaitaire…) et, d’autre part, les date et heure de connexion correspondant à la participation au Jeu clairement soulignées ou surlignées par le Participant.

Etant observé qu'en l'état actuel des offres de services et de la technique, certains fournisseurs d'accès à Internet offrent une connexion gratuite ou forfaitaire aux internautes, il est expressément convenu que toute participation au Jeu s'effectuant sur une base gratuite ou forfaitaire (tels que notamment connexion par câble, ADSL ou liaison spécialisée) ne pourra donner lieu à aucun remboursement, dans la mesure où l'abonnement aux services du fournisseur d'accès est dans ce cas contracté par le Participant pour son usage de l'Internet en général et que le fait pour le Participant de se connecter à la plateforme et de participer au Jeu ne lui occasionne aucun frais ou débours supplémentaire.

Les frais de photocopie des éventuels justificatifs à fournir seront remboursés sur la base de 0,10 euro TTC par feuillet.

Article 8. Loi applicable et juridiction compétente

Préalablement à toute action en justice relative à ou en relation avec ce Règlement (en particulier leur application ou interprétation), les Participants s'engagent à prendre contact avec Getaround afin de tenter de régler leur différend de manière amiable et extrajudiciaire.

Les Participants sont soumis à la réglementation française applicable. Tout litige ne pouvant être réglé à l'amiable sera porté devant les juridictions compétentes en France.
