RULES - ENGLISH VERSION

Getaround (SAS with a capital of €1,231,552.50 - RCS Paris n°522 816 651 - registered office at 35 rue Greneta 75002) has decided to launch a photo competition on its Instagram page accessible via @getaround_europe (the "Game") to offer one (1) Participant (as defined below) a voucher to the value of fifty euros (€50), valid for six (6) months on the Getaround platform, which can be accessed via es.getaround.com as of its issue (the "Prize").

Participation in the Game implies full acceptance and submission of these Game rules and regulations which are set out in the terms and conditions of the Game (the "Rules"), Getaround's general terms and conditions of use available here, the privacy policy (the "Privacy Policy") available here, and the rules of conduct in force on the Internet (netiquette, codes of conduct, etc.).

Any breach of one or more of the above terms and conditions may, at Getaround's discretion, result in the Participant's disqualification from the Game.

Article 1. Conditions of Entry

1.1 This Game is open to any person meeting the following cumulative conditions (the "Participant"):

• registered as a renter on the Getaround platform (i.e. registered on the platform to rent a vehicle)
• A permanent resident in Spain;
• of legal age in their country on the day they enter the competition;
• have access to an internet connection, and;
• have a valid email address.

Only one entry per person is permitted (same surname, first name, postal address and email address).

1.2 All employees and representatives of Getaround, its partners and subcontractors, as well as their advisors and family members (direct ascendants and descendants) and spouses (marriage, civil partnership, cohabitation) and minors are excluded from any benefit of the Game.

Article 2. Terms & conditions of entry

The Game runs from 22 July 2022 at 14:00 am until 8 September 2022 at 6:00 pm (the "Game Period").

Participation in the Game takes place as follows:

• On 22 July 2022 at 14:00 a.m., Getaround will publish a post on its Instagram page (@getaround_europe) indicating the terms and conditions of the Game and the link to the Rules;
• During the Contest Period, Participants shall:

-subscribe to Getaround's Instagram account (@getaround_europe) and like the post announcing the Contest

-Take a photo of the rented car via the Getaround platform in accordance with the Criteria defined below (the "Photo").

-At the Participant's option, this Photo must then:

• Be published on his/her instagram account mentioning the hashtag #getaroundeurope and @getaround_europe; or
• Be sent to Getaround's Instragram account (@getaround_europe) via Instagram's direct messaging system.

By submitting their Photo, Participants agree that the Photo may be published on the Getaround account (@getaround_europe) in the event that the Participant is selected as a Winner.

Entries meeting all of the above conditions are hereinafter referred to as "Entries. Participants who do not meet all of these conditions will not be able to attempt to win the Prize, without being able to claim any compensation in any form whatsoever.

To be taken into account, the Photo must meet all of the following criterias (the "Criterias"):

• Be clear and not blurred;
• Showcase a photo of the car rented via the Getaround platform by the Participant;
• Showcase the car or a distinctive feature of the car (interior or exterior) that is clearly identifiable in the photo;
• The car must be in front of a clear landscape or outdoor area, referring to the holiday.
• Any natural areas (i.e. where driving is prohibited) are excluded;
• Cannot feature traffic violations or excessive speeding of the car and does not exploit the appeal of speed or evoke the power of the car or its braking ability in order to encourage speed;
• Does not contain any content that is sexual, violent, criminal, terrorist, incites hatred, threatening, promotes regulated goods, provides false information, infringes on the services offered by Getaround or any of its competitors, violates the property rights of any third party, or could be considered harassment, nudity or self-harm;
• Adheres to Instagram's terms of use available at https://help.instagram.com/;
• In the event that people are identified or identifiable in the Photo, the Participant must have obtained their permission to use their image in the Game.

Article 3. Designation of the winner and award of the Prize

3.1. As of September 9th, the Publications will be evaluated by the Getaround marketing team who will select, at its sole discretion, one (1) Publication that best meet the Criteria.

3.2. The three Participants who are the authors of the selected Publications will be contacted by Getaround via private Instagram message. If the selected Participant: (i) cannot be contacted; (ii) does not respond within three (3) days and/or (iii) refuses the Prize, the latter shall definitively forfeit the rights to receive the Prize without any subsequent compensation being claimed in this respect. In this case, another Participant will be designated under the same conditions as defined in articles 3.1 and 3.2.

3.3. After contacting the Participant and verifying that they comply with all of the Rules, including any additional checks required by Getaround, the Participant shall be definitively declared "Winner" of the Contest.

3.4. Upon confirmation of their details, and within a maximum of seven (7) working days, the Winner will receive by e-mail the Prize, namely a coupon worth fifty euros (€50) that can be used on the Getaround platform (getaround.com) and is valid for six (6) months from its issue date.

The Prize is personal and cannot be exchanged or refunded for cash and is not refundable or transferable. The Winner will be responsible for the use of the Prize before its expiry date. Any Prize not used during its validity period will become obsolete and remain the property of Getaround.

3.5. The results of the Contest will be communicated to other Participants by sharing on Getaround's Instagram account (@getaround_europe) the Photos of the Winner, mentioning their first name and/or their Instagram nickname and their city of residence. The sharing of the Winner's Photos does not give rise to any consideration other than the Prize to the Winner.

Article 4. Processing of personal data

4.1. In order to participate in the Game, Participants must provide certain personal information about themselves such as their Instagram username or real name. Only the Winner will be required to provide their email address or other identifying information necessary to verify compliance with the Rules and to receive the Prize.

4.2 Any personal data collected by Getaround will be treated in accordance with its privacy policy accessible via https://uk.getaround.com/privacy.

Article 5. Limitation of liability

5.1. INSTAGRAM IS NOT INVOLVED IN ANY WAY IN THE ORGANIZATION OF THE GAME. THE GAME IS NOT MANAGED, SPONSORED OR ENDORSED BY INSTAGRAM. INSTAGRAM SHALL IN NO WAY BE HELD LIABLE IN THE EVENT OF A DISPUTE RELATED TO THE GAME. FOR ANY QUESTIONS, COMMENTS AND/OR COMPLAINTS REGARDING THE GAME, PARTICIPANTS SHOULD SEND A PRIVATE MESSAGE TO THE INSTAGRAM ACCOUNT OF GETAROUND (@GETAROUND_EUROPE).

5.2 Getaround shall not be held responsible for any loss, delay, error, in particular due to a failure of computer equipment, software, Internet browsers, computer networks or Internet connections affecting or not affecting the Participants' computer equipment.

5.3. Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network. Consequently, Getaround shall not be held responsible under any circumstances, without this list being exhaustive, for

• the transmission and/or reception of any data and/or information on the Internet;
• any malfunction of the Internet network preventing the proper conduct/functioning of the Game;
• failure of any receiving equipment or communication lines;
• loss of any paper or electronic mail and, more generally, loss of any data;
• problems with delivery;
• the functioning of any software;
• the consequences of any virus, computer bug, anomaly, technical failure;
• any damage caused to a Participant's equipment;
• any technical, hardware or software failure of any kind, which prevents or limits the possibility of participating in the Game or which damages a Participant's system;
• the malfunctioning of the Prize distributed in the context of the Contest, and any direct and/or indirect damage that they may cause.

5.3 Getaround may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, including computer fraud. Getaround reserves the right, in such a case, not to award the Prize to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts. Getaround shall not, however, incur any liability whatsoever towards the Participants as a result of any fraud committed.

5.4. Getaround reserves the right to permanently exclude from the Game any person who, through fraudulent behavior, interferes with the proper conduct of the Game, in particular but not exclusively, through the use of robots or any other automated process.

5.5. Getaround shall not be liable in any way for any loss or damage arising from the acceptance and/or use of the Prize.

5.6. Getaround reserves the right to cancel, suspend or modify the Game in the event that the Game cannot be completed due to an event of force majeure, or any bug, virus, intrusion or technical error.

Article 6. Literary and Artistic Property Rights

The images used on Getaround's Instagram account, the objects represented, the brands and trade names mentioned, the graphic elements, the computer elements and the databases making up the Game are the exclusive property of their respective owners and may not be extracted, reproduced or used without the written authorisation of the latter, under penalty of civil and/or criminal proceedings.

Article 7. Reimbursement of participation fees

Postage costs related to requests for the Rules (second-class postage at the current rate), can be reimbursed on simple written request by sending banking details (RIB, RIP or RICE) to the following address:

Reimbursement of internet connection costs for participation in the Game, up to a maximum of 3 minutes and excluding mobile participation, may be obtained by sending a written request to the Getaround address, clearly specifying the following information: surname, first name, full postal address, date and time of participation. The request for reimbursement must be accompanied by a bank details form and a copy of the Participant's internet service provider's invoice showing: the exact nature of the internet service provider's service and its method of invoicing (unlimited, flat rate, etc.) and, the date and time of connection corresponding to participation in the Game clearly underlined or highlighted by the Participant.

Given the current state of services and technology, some Internet service providers offer a free or flat-rate connection to Internet users, it is expressly agreed that any participation in the Game carried out on a free or flat-rate basis (such as, in particular, connection by cable), it is expressly agreed that participation in the Game on a free or flat-rate basis (such as connection by cable, ADSL or specialised connection) shall not give rise to any reimbursement, insofar as the subscription to the services of the access provider is, in this case, contracted by the Participant for his/her use of the Internet in general and the fact that the Participant connects to the platform and participates in the Game does not give rise to any additional costs or expenses.

The cost of photocopying any supporting documents to be provided will be reimbursed on the basis of 0.10 euro (including tax) per sheet.

Article 8. Applicable law & jurisdiction

Prior to any legal action relating to or in connection with these Rules (in particular their application or interpretation), Participants can choose to contact Getaround in order to attempt to settle their dispute amicably and extrajudicially.

Participants are subject to French regulations and laws. Any dispute that cannot be settled amicably shall be brought before the competent courts in France.

RULES - ES VERSION

Getaround (SAS con un capital de 1.231.552,50 euros - RCS París n°522 816 651 - domicilio social en 35 rue Greneta 75002) ha decidido lanzar un concurso de fotografía en su página de Instagram accesible a través de @getaround_europe (el "Juego") para ofrecer a un (1) Participante (tal y como se define a continuación) un vale por valor de cincuenta euros (50€), válido durante seis (6) meses en la plataforma Getaround, al que se puede acceder a través de es.getaround.com a partir de su emisión (el "Premio").

La participación en el Juego implica la plena aceptación y el sometimiento a estas reglas y normas del Juego que se establecen en los términos y condiciones del Juego (las "Reglas"), los términos y condiciones generales de uso de Getaround disponibles aquí, la política de privacidad (la "Política de Privacidad") disponible aquí, y las normas de conducta vigentes en Internet (netiquette, códigos de conducta, etc.).

Cualquier incumplimiento de uno o más de los términos y condiciones anteriores puede, a discreción de Getaround, dar lugar a la descalificación del Participante del Juego.

Artículo 1. Condiciones de entrada

1.1 Este Juego está abierto a cualquier persona que cumpla las siguientes condiciones acumulativas (el "Participante"):

• estar registrado como conductor en la plataforma Getaround (es decir, estar registrado en la plataforma para alquilar un vehículo)
• Ser residente permanente en España
• ser mayor de edad en su país el día en que participe en el Juego
• tener acceso a una conexión a Internet, y
• tener una dirección de correo electrónico válida.

Sólo se permite una participación por persona (mismo apellido, nombre, dirección postal y dirección de correo electrónico).

1.2 Quedan excluidos de cualquier beneficio del Juego todos los empleados y representantes de Getaround, sus socios y subcontratistas, así como sus asesores y familiares (ascendientes y descendientes directos) y cónyuges (matrimonio, pareja de hecho, convivencia) y menores de edad.

Artículo 2. Condiciones de entrada

El Juego se desarrolla desde el 22 de julio de 2022 a las 14:00 horas hasta el 8 de septiembre de 2022 a las 18:00 horas (el "Periodo de Juego").

La participación en el Juego tiene lugar de la siguiente manera:

• El 22 de julio de 2022 a las 14:00 horas, Getaround publicará un post en su página de Instagram (@getaround_europe) indicando los términos y condiciones del Juego y el enlace a las Reglas;
• Durante el Periodo del Juego, los Participantes deberán

-suscribirse a la cuenta de Instagram de Getaround (@getaround_europe) y darle a me gusta al post que anuncia el Juego

-Hacer una foto del coche alquilado a través de la plataforma de Getaround de acuerdo con los Criterios definidos a continuación (la "Foto").

-A elección del Participante, esta Foto debe entonces:

• Ser publicada en su cuenta de instagram mencionando el hashtag #getaroundeurope y @getaround_europe; o
• Ser enviada a la cuenta de Instagram de Getaround (@getaround_europe) a través del sistema de mensajería directa de Instagram.

Al enviar su Foto, los Participantes aceptan que ésta pueda ser publicada en la cuenta de Getaround (@getaround_europe) en caso de que el Participante sea seleccionado como Ganador.

Las participaciones que cumplan todas las condiciones anteriores se denominarán en lo sucesivo "Participaciones". Los Participantes que no cumplan con todas estas condiciones no podrán intentar ganar el Premio, sin poder reclamar ninguna compensación de ningún tipo.

Para tener en cuenta, la fotografía debe cumplir todos los criterios siguientes (los "Criterios"):

• exterior clara, referida a las vacaciones.
• Quedan excluidas las zonas naturales (es decir, donde está prohibido conducir);
• No puede presentar infracciones de tráfico o exceso de velocidad del coche y no explota el atractivo de la velocidad ni evoca la potencia del coche o su capacidad de frenado para fomentar la velocidad;
• No contiene ningún contenido sexual, violento, delictivo, terrorista, que incite al odio, que sea amenazante, que promueva productos regulados, que proporcione información falsa, que infrinja los servicios ofrecidos por Getaround o cualquiera de sus competidores, que viole los derechos de propiedad de cualquier tercero, o que pueda considerarse acoso, desnudez o autolesión;
• Se adhiere a las condiciones de uso de Instagram disponibles en https://help.instagram.com/;
• En el caso de que se identifique o identifique a personas en la Foto, el Participante debe haber obtenido su permiso para utilizar su imagen en el Juego.

Artículo 3. Designación del Ganador y concesión del Premio

3.1. A partir del 9 de septiembre, las Publicaciones serán evaluadas por el equipo de marketing de Getaround, que seleccionará, a su entera discreción, la (1) Publicación que mejor cumplan los Criterios.

3.2. El Participante autor de la Publicación seleccionada será contactado por Getaround a través de un mensaje privado de Instagram. Si el Participante seleccionado: (i) no puede ser contactado; (ii) no responde en el plazo de tres (3) días y/o (iii) rechaza el Premio, éste perderá definitivamente los derechos a recibir el Premio sin que pueda reclamarse ninguna compensación posterior al respecto. En este caso, se designará a otro Participante en las mismas condiciones definidas en los artículos 3.1 y 3.2.

3.3. Tras ponerse en contacto con el Participante y comprobar que cumple con todas las Normas, incluidas las comprobaciones adicionales requeridas por Getaround, el Participante será declarado definitivamente "Ganador" del Juego.

3.4. Una vez confirmados sus datos, y en un plazo máximo de siete (7) días laborables, el Ganador recibirá por correo electrónico el Premio, a saber, un cupón por valor de cincuenta euros (50 €) que podrá utilizarse en la plataforma Getaround (getaround.com) y que será válido durante seis (6) meses a partir de su fecha de emisión.

El Premio es personal y no puede cambiarse ni reembolsarse por dinero en efectivo y no es reembolsable ni transferible. El Ganador será responsable del uso del Premio antes de su fecha de caducidad. Todo Premio no utilizado durante su período de validez quedará obsoleto y será propiedad de Getaround.

3.5. Los resultados del Juego se comunicarán a otros Participantes compartiendo en la cuenta de Instagram de Getaround (@getaround_europe) la Foto del Ganador, mencionando su nombre y/o su nickname de Instagram y su ciudad de residencia. El hecho de compartir la Foto del Ganador no da lugar a ninguna otra contraprestación que no sea el Premio al Ganador.

Artículo 4. Tratamiento de datos personales

4.1. Para participar en el Juego, los Participantes deben proporcionar cierta información personal sobre sí mismos, como su nombre de usuario de Instagram o su nombre real. Solo el Ganador deberá proporcionar su dirección de correo electrónico u otra información de identificación necesaria para verificar el cumplimiento de las Reglas y recibir el Premio.

4.2 Cualquier dato personal recogido por Getaround será tratado de acuerdo con su política de privacidad accesible a través de https://es.getaround.com/privacy.

Artículo 5. Limitación de la responsabilidad

5.1. INSTAGRAM NO PARTICIPA DE NINGUNA MANERA EN LA ORGANIZACIÓN DEL JUEGO. EL JUEGO NO ESTÁ GESTIONADO, PATROCINADO NI AVALADO POR INSTAGRAM. INSTAGRAM NO SE RESPONSABILIZA DE NINGUNA MANERA EN CASO DE DISPUTA RELACIONADA CON EL JUEGO. PARA CUALQUIER PREGUNTA, COMENTARIO Y/O QUEJA RELACIONADA CON EL JUEGO, LOS PARTICIPANTES DEBERÁN ENVIAR UN MENSAJE PRIVADO A LA CUENTA DE INSTAGRAM DE GETAROUND (@GETAROUND_EUROPE).

5.2 Getaround no se hace responsable de ninguna pérdida, retraso o error, en particular debido a un fallo del equipo informático, del software, de los navegadores de Internet, de las redes informáticas o de las conexiones a Internet que afecten o no al equipo informático de los Participantes.

5.3. La participación en el Juego implica el conocimiento y la aceptación de las características y los límites de Internet, en particular en lo que se refiere a las prestaciones técnicas, los tiempos de respuesta para la consulta, la consulta o la transferencia de información, los riesgos de interrupción y, de forma más general, los riesgos inherentes a cualquier conexión y transmisión en Internet, la falta de protección de determinados datos contra una posible apropiación indebida y los riesgos de contaminación por cualquier virus que circule por la red. En consecuencia, Getaround no se hace responsable en ningún caso, sin que esta lista sea exhaustiva, de

• la transmisión y/o recepción de cualquier dato y/o información en Internet
• cualquier mal funcionamiento de la red de Internet que impida el correcto desarrollo/funcionamiento del Juego;
• el fallo de cualquier equipo receptor o de las líneas de comunicación
• la pérdida de cualquier papel o correo electrónico y, en general, la pérdida de cualquier dato
• problemas de entrega;
• el funcionamiento de cualquier software
• las consecuencias de cualquier virus, error informático, anomalía, fallo técnico;
• cualquier daño causado al equipo del Participante;
• cualquier fallo técnico, de hardware o de software de cualquier tipo, que impida o limite la posibilidad de participar en el Juego o que dañe el sistema de un Participante;
• el mal funcionamiento del Premio distribuido en el marco del Juego, así como los daños directos y/o indirectos que puedan causar.

5.3 Getaround podrá anular total o parcialmente el Juego si se comprueba que se ha producido un fraude en cualquiera de sus formas, incluido el fraude informático. Getaround se reserva el derecho, en tal caso, de no conceder el Premio a los defraudadores y/o de perseguir a los autores de dicho fraude ante los tribunales competentes. No obstante, Getaround no incurrirá en responsabilidad alguna frente a los Participantes como consecuencia de cualquier fraude cometido.

5.4. Getaround se reserva el derecho de excluir permanentemente del Juego a cualquier persona que, mediante un comportamiento fraudulento, interfiera en el correcto desarrollo del mismo, en particular, pero no exclusivamente, mediante el uso de robots o cualquier otro proceso automatizado.

5.5. Getaround no será responsable en ningún caso de las pérdidas o daños derivados de la aceptación y/o uso del Premio.

5.6. Getaround se reserva el derecho de cancelar, suspender o modificar el Juego en caso de que éste no pueda llevarse a cabo debido a un acontecimiento de fuerza mayor, o a cualquier fallo, virus, intrusión o error técnico.

Artículo 6. Derechos de propiedad literaria y artística

Las imágenes utilizadas en la cuenta de Instagram de Getaround, los objetos representados, las marcas y nombres comerciales mencionados, los elementos gráficos, los elementos informáticos y las bases de datos que componen el Juego son propiedad exclusiva de sus respectivos propietarios y no pueden ser extraídos, reproducidos o utilizados sin la autorización escrita de éstos, bajo pena de acciones civiles y/o penales.

Artículo 7. Reembolso de los derechos de participación

Los gastos de envío relacionados con las solicitudes de las Reglas (franqueo de segunda clase a la tarifa vigente), pueden ser reembolsados con una simple solicitud por escrito enviando los datos bancarios (RIB, RIP o RICE) a la siguiente dirección:

El reembolso de los costes de conexión a Internet por la participación en el Juego, hasta un máximo de 3 minutos y excluyendo la participación móvil, puede obtenerse enviando una solicitud por escrito a la dirección de Getaround, especificando claramente la siguiente información: apellidos, nombre, dirección postal completa, fecha y hora de participación. La solicitud de reembolso deberá ir acompañada de un formulario de datos bancarios y de una copia de la factura del proveedor de servicios de Internet del Participante en la que se indique: la naturaleza exacta del servicio del proveedor de Internet y su método de facturación (ilimitado, tarifa plana, etc.) y, la fecha y la hora de conexión correspondientes a la participación en el Juego claramente subrayadas o destacadas por el Participante.

Dado el estado actual de los servicios y la tecnología, algunos proveedores de servicios de Internet ofrecen una conexión gratuita o de tarifa plana a los usuarios de Internet, se acuerda expresamente que cualquier participación en el Juego realizada sobre una base gratuita o de tarifa plana (como, en particular, la conexión por cable), se acuerda expresamente que la participación en el Juego sobre una base gratuita o de tarifa plana (como la conexión por cable, ADSL o conexión especializada) no dará lugar a ningún reembolso, en la medida en que la suscripción a los servicios del proveedor de acceso es, en este caso, contratada por el Participante para su uso de Internet en general y el hecho de que el Participante se conecte a la Plataforma y participe en el Juego no da lugar a ningún coste o gasto adicional.

El coste de las fotocopias de los documentos justificativos que deban aportarse se reembolsará a razón de 0,10 euros (impuestos incluidos) por hoja.

Artículo 8. Ley aplicable y jurisdicción

Antes de emprender cualquier acción legal relacionada con las Reglas (en particular su aplicación o interpretación), los Participantes pueden optar por ponerse en contacto con Getaround para intentar resolver su conflicto de forma amistosa y extrajudicial.

Los Participantes están sujetos a la normativa y las leyes francesas. Cualquier disputa que no pueda ser resuelta de forma amistosa será llevada ante los tribunales competentes en Francia.
